Terms of Service

Welcome to Foundsite. By submitting an intake form, making a payment, or using any service provided by Foundsite ("we", "us", "our"), you agree to the following terms. Please read them carefully.

1. Services

Foundsite builds and hosts professional websites for local businesses. Our services include website design and development, domain connection, hosting, maintenance, and optional add-on services as outlined on our pricing page.

All work is based on the information you provide in your intake form. It is your responsibility to provide accurate business details, content, and any assets such as photos or logos.

2. Setup Fee and Payment

A one-time setup fee is required before any work begins. This fee is non-refundable once work has started. Work begins within 2 business days of payment clearing.

Setup fees:

• Starter Site: $299 CAD
• Business Site: $599 CAD

Payment is processed securely via Stripe. By submitting payment you authorize Foundsite to charge the amount shown.

3. Monthly Hosting and Maintenance

Monthly hosting begins on your site launch date. Your first monthly charge is processed 30 days after your site goes live. Subsequent charges occur on the same date each month automatically via Stripe.

Monthly fees:

• Starter Site: $20 CAD per month
• Business Site: $35 CAD per month

Your monthly fee covers website hosting, uptime monitoring, and maintenance. If your site experiences a technical issue caused by our infrastructure, we will resolve it at no additional charge.

4. Content Updates

Your plan includes a set number of content updates per year:

• Starter Site: 2 updates per year
• Business Site: 6 updates per year

A content update includes changes such as updating hours, swapping a photo, editing copy, or adding a new menu item. A content update does not include adding new pages, redesigning sections, or building new features. Those are treated as add-on work and quoted separately.

Updates must be requested by email and will be completed within 5 business days.

5. Revisions During Build

After we send you your staging site for review, you have 2 rounds of revision requests included in your setup fee. A revision round is one consolidated list of changes. Additional revision rounds after the second are billed at $50 CAD each.

Please review your staging site carefully before requesting revisions. Changes requested after the site has gone live are counted against your annual content update allowance.

6. Domain Names

You are responsible for purchasing and maintaining your own domain name. Foundsite will connect your domain to your site at no additional charge as part of the setup process.

If you need assistance purchasing a domain, we offer a domain setup service for an additional fee as listed on our pricing page.

You must provide us with access to your domain registrar account or add the DNS records we specify. Foundsite is not responsible for delays caused by domain propagation or registrar issues outside our control.

If you cancel your hosting and wish to use your domain elsewhere, you remain the owner of your domain and may point it to any host you choose.

7. Cancellation Policy

You may cancel your hosting at any time by emailing us at hello@foundsite.co.

When you cancel:

• Your site remains live until the end of your current paid billing period
• No further charges are made after your cancellation is confirmed
• Within 5 business days of your site coming down, we will send you a zip file containing your complete site files at no charge
• Your site files are yours to keep and host elsewhere

Your setup fee is non-refundable under any circumstances, as it covers work already completed.

8. Ownership of Work

Upon full payment of your setup fee, you own the website we built for you. You are free to take your files and host them anywhere.

Foundsite retains the right to display your completed website in our portfolio and examples section unless you request otherwise in writing.

9. Limitation of Liability

Foundsite is not liable for any loss of revenue, customers, or business opportunities resulting from website downtime, errors, or delays. Our total liability to you for any claim under these terms is limited to the amount you paid us in the 30 days preceding the claim.

We aim for 99% uptime but do not guarantee it. Scheduled maintenance, third-party outages, or circumstances beyond our control may cause temporary unavailability.

10. Acceptable Use

You agree not to use your Foundsite website for any unlawful purpose, to distribute harmful or misleading content, or to violate the rights of any third party. We reserve the right to take down any site that violates these terms without refund.

11. Changes to These Terms

We may update these terms from time to time. We will notify you by email of any material changes. Continued use of our services after notification constitutes acceptance of the updated terms.

12. Governing Law

These terms are governed by the laws of the Province of Ontario, Canada. Any disputes will be resolved in the courts of Ontario.
